صنفي معلمان را متوقف کنيد

فرزاد کمانگر؛ معلم 33 ساله و عضو کانون صنفي معلمان در کردستان ايران در خطر
اعدامي قرار دارد که در يک دادگاه ناعادلانه برايش صادر شده است.
ايي آي در هفته هاي اخير، بارها به دولت ايران نامه نوشته و تقاضاي دادرسي عادلانه
براي فرزاد کمانگر و ساير اعضاي اتحاديه هاي کارگري را داشته که در بازداشت هستند.
عليرغم تلاشهاي مشترک از سوي سازمانهاي ملي و بين المللي براي تغيير حکم اعدام
فرزاد کمانگر، اين حکم در تاريخ 21 تيرماه 1387 توسط ديوان عالي تائيد شد. علاوه بر
اينها، همکاران عضو کانونهاي صنفي معلمان و فعالان حقوق بشر که با فرزاد اعلام
همبستگي کرده اند بطور گسترده توسط مقامات ايراني تهديد مي شوند.
دستگيري، بازداشت و تقبيح اعضاي اتحاديه هاي کارگري بخاطر فعاليتهاي حقوق بشري و
اتحاديه کارگري آنها نه تنها حقوق اتحاديه کارگري را بشدت نقض مي کند بلکه فضاي
وحشتي ايجاد مي کند که مانع توسعه اتحاديه هاي کارگري در ايران مي شود.
سابقه موضوع
کمانگر؛ معلمي که در مناطق روستايي تدريس مي کرد و يک فعال حقوق بشري بود، مت با
ادعاي عضويت در حزب کارگران کردستان، پ کا کا به تروريست متهم شده است. به گفته
خليل بهراميان؛ وکيل فرزاد، هيچ سندي براي توجيه اينکه کمانگر "امنيت ملي را به خطر
انداخته" وجود ندارد. وکيل فرزاد؛ که فرصت دفاع از فرزاد به او داده نشد، معتقد است
که دادگاه فرزاد با اصل 168 قانون اساسي جمهوري اسلامي ايران انطباق ندارد که در آن
تاکيد شده است :"رسيدگي به جرايم سياسي و مطبوعاتي علني است و با حضور هئيت منصفه
در محاکم دادگستري صورت مي گيرد." در مورد پرونده فرزاد کمانگر، فقط يک قاضي پرونده
را در مدت 5 دقيقه بررسي کرد و به متهم اجازه صحبت داده نشد.
کميته حمايتي اي مرکب ازاعضايي از کانون صنفي معلمان، همکاران سابق کمانگر و
وکلاي حقوق بشر از جمله شيرين عبادي، برنده جايزه نوبل، در تاريخ 11 تيرماه 1387
براي دفاع از حقوق شهروندي فرزاد کمانگر و انجام اقدامات قانوني براي تغيير حکم
فرزاد کمانگر تشکيل شد. سه معلم در کامياران دستگير شده و به بازداشتگاه اداره
اطلاعات سنندج منتقل شدند . دو تن از اين معلمان به نام هاي حسن قرباني و کاوه
رستمي، هنوز در بازداشت هستند در حالي که احمد قرباني پس از دو هفته با قرار وثيقه
آزاد شد. حاميان فرزاد و اعضاي خانواده او بطور مرتب مورد تهديد تلفني وزارت امنيت
و اطلاعات هستند.
ايي آي علاوه بر مخالفت با حکم اعدام فرزاد کمانگر، شکنجه فرزاد را در مدتي که در
بازداشت بوده و محروميت ايشان از درمان پزشکي را محکوم مي کند. زماني که
خانواده فرزاد بالاخره اجازه ديدار با او را در زندان دريافت کردند، ميزان جراحات
ايشان به قدري بود که فرزاد نمي توانست راه برود. ايي آي به مقامات ايراني پيشنهاد
مي کند که گزارش شکنجه فرزاد را مورد تحقيق قرار داده و مطمئن شود که در آينده هيچ
فرد بازداشتي اي مورد شکنجه و بد رفتاري قرار نخواهد گرفت.
ايي آي در حال حاضر هيچ عضو وابسته اي در ايران ندارد. اما ايي آي تقاضاي عضويت از
طرف کانون هاي صنفي معلمان ايران دريافت کرده و نماينده اين کانون بعنوان ميهمان به
آخرين کنگره ايي آي در برلين در سال 1386 دعوت شده بود. به محض بازگشت آقاي محمد
خاکساري از کنگره ايي آي، ايشان توسط نيروهاي امنيتي مورد آزار و اذيت قرار گرفت.
آقاي خاکساري عضو فعال "کميته نجات فرزاد" است و از جمله افرادي است که توسط وزارت
اطلاعات تهديد مي شود.
شما چه مي توانيد بکنيد؟
بعنوان انجمن ملي معلمان، شما مي توانيد اين اقدامات را انجام دهيد:
1) وضعيت فرزاد کمانگر و معلمان ايران را در مجله هاي خود، وب سايتها، در نشست هاي
خودتان و به طرق مناسب ديگر به بحث بگذاريد.
2) به مقامات ايران نامه بنويسيد. از سازمان شما مي خواهيم که از دولت ايران موارد
ذيل را در نامه هايتان خواستار شويد:
- بررسي پرونده فرزاد کمانگر و روشن ساختن اتهامات عليه فرزاد و ساير معلمان
عضو کانون هاي صنفي معلمان که بازداشت شده اند.
- تغيير حکم اعدام فرزاد کمانگر
- توقف شکنجه
- به فرزاد اجازه داده شود که با خانواده و وکيل خود آزادانه تماس داشته باشد.
- آزار و اذيت اعضاي خانواده فرزاد کمانگر و اعضاي کميته توقف حکم اعدام فرزاد
کمانگر، را متوقف کنند
- باب گفتگوي مسالمت آميز را در باره نگراني هاي حرفه اي معلمان در ايران باز کنند.

Urgent Action Appeal

Stop the execution of teacher unionist Farzad Kamangar
Dear colleagues,
Farzad Kamangar, a 33-year old teacher and former trade unionist from the
Kurdistan Province of Iran, is at risk of execution following the ruling issued
at an unfair trial.
In recent weeks, EI has written to the Iranian Government to request a fair
trial for Farzad Kamangar and other union activists who are under arrest. In
spite of joint efforts from various national and international organisations to
have death sentence of Farzad Kamangar communted, it was upheld by the Supreme
Court on 11 July 2008. In addition, Iranian trade union colleagues and human
rights activists who show solidarity with Farzad are being subjected to
pervasive intimidation by the Iranian authorities.
The arrest, detention and condemnation of trade unionists because of their human
and trade union activities are not only serious violations of trade union
rights, but also create an atmosphere of fear prejudicial to trade union
development in Iran.
Background Information
Kamangar, who worked as a teacher in rural areas and was a human rights
activist, is accused of being a terrorist through his alleged affiliation to the
Kurdistan Workers’ Party, PKK. According to his lawyer, Khalil Bahramian, there
is no evidence to justify the judgement that Kamangar has “endangered national
security”. His lawyer, who was not permitted to defend him, says Farzad’s trial
was not in accordance with article 168 of the Iranian Constitution: “Political
and press offences will be tried openly and in the presence of a jury, in courts
of justice.” In this case, only one judge reviewed the case within five minutes
and the defendant was not allowed to speak.
A support committee composed of members of the Teacher Trade Association, former
colleagues of Kamangar and human rights attorneys, including Nobel Prize winner
Shirin Ebadi, was established on July 21, 2008 to defend the civil rights of
Farzad Kamangar and to undertake legal actions to have his death sentence
commuted. Following the first meeting of the Committee, three teachers were
arrested and taken to the Intelligence Detention Centre in Sanandaj, in the
Iranian province of Kurdistan. Two - Hassan Ghorbani and Kaveh Rostami- are
still in detention, while the third, Ahmad Ghorbani, was released on bail after
two weeks. Farzad’s supporters and their family members are regularly
intimidated through phone calls by the Ministry of Intelligence and National
Security.
In addition to opposing the death sentence, EI condemns the torture of Farzad
Kamangar while in detention and the subsequent denial of medical treatment. When
his family was last allowed to visit him in prison, his injuries were such that
he was unable to walk. EI has urged the Iranian authorities to investigate the
reports of torture and to ensure that, in future, no detainee is subject to
torture or ill-treatment.
To date, EI has no affiliate in Iran. However EI has received an application for
membership from the Iranian Teacher’ Trade Association and a representative of
that organisation was invited as a guest to the last EI Congress in Berlin in
2007. Upon his return from the EI Congress, Mohammad Khaksari was harassed by
the security forces. Mr Khaksari is also an active member of the ‘Committee to
Save Farzad’ and he is among those who are being harassed by the Ministry of
Intelligence.
What can you do?
As a national teacher association, you can undertake the following actions:
1. Give visibility to the situation of Farzad Kamangar and of teachers in Iran
in your magazine, on your website, during meetings and via other appropriate
means.
2. Write to the Iranian authorities > Your organisation is invited to appeal the
Iranian government to:
o
review the case of Farzad Kamangar
and to give further clarification about the charges against him and other
teacher trade unionists currently detained;
o
commute Farzad’s death sentence;
o
desist from the use of torture;
o
allow Farzad Kamangar to have
unimpeded contact with his family and his lawyer;
o
stop the harassment against the
relatives of Farzad Kamangar and members of the Committee to Stop Farzad
Kamangar’s Death Sentence;
o
be open for a peaceful dialogue
regarding the professional concerns of teachers in Iran.
