 نابود سازی عمدی ميراث فرهنگی جهانی و رفتارهای سيستماتيک برای نابود سازی آثار تاريخی و ميراث فرهنگی ملی بايد به عنوان جرايمی عليه بشريت به حساب بيايند
نابود کننده های تنديس بودا و جايگاه های تاريخی مثل دشت پاسارگاد بايد تحت تعقيب قانونی قرار گيرند

موضوع: پیشنهاد متمم برای اساسنامه دادگاه جنایی بین المللی

آقایان محترم:
یکی از مهمترین گامهایی که جامعه جهانی در راستای تکامل بعنوان یک جامعه متمدن و یکپارچه جهانی برداشته، اساسنامه رم، که در سال 2002 اجرایی شد، و ایجاد دادگاه جنایی بین المللی بود.
اساسنامه رم با خشونت سازمانی انسان علیه انسان و جنایات تجاوز، که اینهمه در طول تاریخ بشر رایج بوده اند، برخورد می کند. این اساسنامه یک گام بلند توسط جامعه انسانی برای اجرای قانون علیه تخلفات حقوق بشری که در آن جان انسانها مطرح است می باشد.
اجرای قانون علیه جنایتکارانی که بر یوگوسلاوی، رواندا و حتی عراق حکومت می کردند، نشان داد که جامعه جهانی دیگر جنون ناشی از شهوت قدرت و دیکتاتوری را تحمل نخواهد کرد، و نیز اینکه دیگرهیچ دیکتاتور بیرحمی که با زور و ترس حکومت میکند، هرگز در خانه اش هم امن نخواهد بود.
اکنون ما آماده هستیم که یک گام دیگر به جلو، در راستای پاکسازی جهان از حکومت رادیکال های بی رحم و بی ریشه که نه تنها انسانهای مخالف جامعه خیالی ایدئولوژیکی خود را نابود می کنند، بلکه بطور سازمان یافته میراث فرهنگی انسانهای متمدن را که نقاط عطف در مسیر تکامل تمدن بشری است و همچنین سرچشمه هویت ملی و شخصی و احترام به خویشتن است، به نابودی می کشانند.
بنابراین، من پیشنهاد می کنم که متمم های زیر به بخش2 اساسنامه دادگاه جنایی بین المللی (اساسنامه رم) افزوده شود تا دادگاه بتواند آنان را که بطور عمد میراث تاریخی و فرهنگی جهانی و ملت ها را نابود می کنند تحت تعقیب قرار دهد. بعنوان مثال می توان نابودسازی تندیس بودا و اقلام تاریخی بی شمار در افغانستان توسط طالبان، و نابودی مستمر و جاری جایگاه های تاریخی و فرهنگی در ایران، مانند دشت پاسارگاد و آرامگاه کورش بزرگ، است که هر دو میراث جهانی و بشری بشمار می آیند.
پیشنهاد:
فصل 5. جنایات در صلاحیت دادگاه
افزوده شود: (e) نابود سازی میراث فرهنگی
فصل 7. جنایات علیه بشریت
افزوده شود: (l) نابودسازی عمدی میراث فرهنگی جهانی
افزوده شود: (j) هدف پاراگراف l : "نابودسازی عمدی میراث فرهنگی جهانی" یعنی نابودسازی برنامه ریخته شده و عمدی سازه ها، ابزار، جایگاه ها، و آثار هنری تاریخی که میراث فرهنگی به شمار می آیند و در سازمان یونسکو ثبت شده اند، و/یا روندی از رفتار که شامل دستورهای متعدد یا سیستماتیک برای نابودسازی آثار تاریخی و میراث فرهنگی ملی باشد.
من امیدوارم که این پیشنهاد مورد توجه قرار گیرد، زیرا باور دارم در حالیکه نفس و خون زندگی فیزیکی ما را تامین می کند و باید از آن محافطت شود، میراث فرهنگی هویت و تعادل روانی جامعه انسانی را فراهم می سازد که بدون آن جامعه انسانی روح خود را از دست می دهد.

"Examples of such crimes are the destruction of the statue of Buda and numerous historical artifacts by the Taliban in Afghanistan; and the ongoing destruction of Pasargad historical site in Iran and the tomb of Cyrus the Great, a world cultural heritage."

Subject: Proposal to Amend Rome Statute of the International Criminal Court

Gentlemen,
One of the most significant steps the international community has taken toward a civilized world community was the Rome Statute, entered into force in 2002, and the creation of the International Criminal Court.
The statute deals with organized brutality of man against man and crimes of aggression which have been so rampant over the span of human history. The Statute was a giant step by the human society toward legal enforcement against violations of human rights where the life and physical being of human beings are concerned.
Enforcements against criminals who ruled Yugoslavia, Rwanda and even Iraq showed that insanity stemmed from dictatorial powers is no longer tolerated by the international community and that no ruthless dictator ruling by force and fear will ever be safe again even at home.
We are now ready to take another step forward toward cleaning up the world from the rule of ruthless rootless radicals who not only destroy people who oppose their illusive ideological human society, but engage in systematic destruction of civilized man's cultural heritage which gives him identity and self-esteem and those that represent milestones in human civilization.
Thus, I propose the following amendments be made to PART 2 of the Rome Statute in order to enable the Court to prosecute those who willfully destroy world historical and cultural heritage. Examples of such crimes are the destruction of the statue of Buda and numerous historical artifacts by the Taliban in Afghanistan; and the ongoing destruction of Pasargad historical site in Iran and the tomb of Cyrus the Great, a world cultural heritage.
PROPOSAL:
Article 5. Crimes within jurisdiction of the Court
Add: (e) Destruction of cultural heritage
Article 7. Crimes against humanity
Add: (L) Willful destruction of world cultural heritage
Add: (j) The purpose of paragraph L: "Willful destruction of world cultural heritage" means planned and willful destruction of historical structures, artifacts, sites or artwork considered cultural heritage and registered with UNSESCO as world heritage and/or a course of conduct involving systematic or multiple commission of acts leading to destruction of national historical and cultural heritage.
I hope that this proposal is given due attention, since I believe that while breath and blood provide physical life and must be protected, cultural heritage provides human society with identity, spirit and the feeling of achievement without which society loses its soul.
