اطلاعیه عبدالله مومنی در واکنش به اتهامات وزارت دادگستری آمریکا- انصاف نیوز


عبدالله مومنی در واکنش به اتهامات وارده از سوی وزارت دادگستری دولت آمریکا و تحریم خود از سوی آن اطلاعیه‌ای صادر کرد.

متن کامل اطلاعیه‌ی آقای مومنی که برای انتشار در اختیار انصاف نیوز قرار گرفته است، در پی می‌آید:

به تازگی اطلاعیه‌ای از سوی وزارت دادگستری آمریکا منتشر شده که در آن ادعا شده اینجانب در خرید برخی از اقلامی که ورود آنها به ایران ممنوع بوده نقش داشته‌ام.

با توجه به اینکه موضوع در برخی رسانه‌های داخلی و خارجی انعکاس یافته است لازم دیدم جهت تنویر افکار عمومی توضیحاتی نسبت به این ادعای عجیب ارائه کنم.

اینجانب پس از طی ۵ سال حبس ظالمانه، پس از آزادی در سال ۹۳ و به دنبال اخراج از آموزش و پرورش تقریبا به مدت دوسال با شرکتی متعلق به دوستان و آشنایان که از دهه ۱۳۸۰ فعالیت بازرگانی داشته همکاری داشتم. از جمله فعالیت‌های این شرکت تامین و واردات کالا در چند حوزه محدود از جمله  تجهیزات پزشکی و برخی قطعات یدکی مربوط به صنعت حمل و نقل ریلی بوده است. در دوره همکاری من با شرکت موصوف از جمله چند سفارش تامین کالا نیز به آقای آرش یوسفی جم در کانادا ارجاع شد و نامبرده که به طور مستقل در کانادا فعالیت بازرگانی داشت نیز اقدام به خرید برخی از این کالاها و سپس فروش آنها به این شرکت کرد. توضیح اینکه آشنایی من با آقای یوسفی جم به دوره چندماهه حبس وی در زندان اوین مربوط است و  وی پس از آزادی به کانادا مهاجرت کرده بود. بعلاوه لازم به تذکر است که خرید هیچ یک از کالاها و قطعات مورد بحث مشروط به شرایط و ضوابط خاصی نبوده و معمولا هم خرید آنها از وبسایت‌های فروش معروف amazon  و یا Ebay  انجام شده و هیچگونه کاربرد دوگانه‌ای نداشته اند. به طور خلاصه در واقع آشنایی اینجانب و معرفی آقای یوسفی جم به عنوان یک ایرانی مقیم کانادا که به فعالیت بازرگانی اشتغال داشته به شرکت ایرانی تمام آن چیزی است که از ناحیه من اتفاق افتاده است.

بنابراین من، عبدالله مومنی خود را یک فعال دموکراسی‌خواه و ملتزم به حاکمیت ملی و استقلال کشورم می‌دانم و همواره با اعمال تحریم‌های یکجانبه اقتصادی اعمال شده از سوی دولت آمریکا یا هر دولت دیگری بر ایران که لاجرم منجر به دشواری زندگی مردمان سرزمینم می‌شود مخالف بوده و آن را مصداق ظلم به ملت ایران و نقض حقوق شهروندان ایرانی می‌دانم که این مواضع پیشتر در موضع‌گیری‌های شخصی و یا جمعی اینجانب مکررا اعلام شده است.

با این همه جای تاسف دارد که چگونه دولتی مستقر در یک کشور توسعه یافته، قوانین داخلی خود را قابل اعمال بر اتباع کشوری دیگر می‌داند و آنها را به مجازات تهدید می‌کند و در عین حال مردم همان کشور را از سفر به قلمرو حاکمیت خود ممنوع می‌کند. خوب است وزارت دادگستری ایالات متحده به این پرسش پاسخ دهد که بر اساس کدام قاعده حقوقی اینجانب به عنوان یک فرد خارجی هزاران مایل دورتر از سرزمین ایالات متحده بایستی از قوانین داخلی آن کشور مطلع باشم و آن قواعد برای من لازم الاجرا و موجب مجازات باشد؟  چگونه این روند طنزآلود با حق برخورداری از دادرسی عادلانه همخوانی دارد؟ آیا امروز با حاکمیت قانون جنگل مواجه‌ایم؟

البته همگان می‌دانند که این شیوه‌های غیرمعقول، غیرقانونی و خلاف عرف بین‌المللی نتیجه تصمیمات دولتی در آمریکاست که چهارسال دوره خود را یا صرف ممنوعیت و دیوارکشی و حمله به ارزش‌های دموکراتیک کرد و یا در سیاست خارجی صرفا به دنبال عکس یادگاری با دیکتاتورهایی مثل رهبر کره شمالی و تندروهای مذهبی در افغانستان بود. دولتی که البته کارنامه و رویکردهایش از سوی اکثریت مردم آمریکا رد و نفی شد.

من همچنین لازم می‌دانم با صدای رساتر از گذشته اعلام کنم که از جمله اولویت‌های امروز کشور ما شفافیت و مبارزه با فساد در هر سطحی است و کینه‌توزی‌ها و فضاسازی‌ها علیه نیروهای باورمند به تحول خواهی درون‌زا تاثیری بر اراده من نخواهد گذاشت. به هر روی غیر منتظره نخواهد بود همچون منی که در منتهای توان خود همواره با دخالت خارجی و استبداد داخلی مخالفت کرده به این ترتیب مغضوب هر دو شده باشد. امری که البته آن را به فال نیک می‌گیرم.

Announcement of Abdollah Momeni in reaction to the allegations by the US Department of Justice:

Recently, a statement was issued by the US Department of Justice claiming that I was involved in purchasing some items that were banned from exporting to Iran according to the US laws.

Given that the issue has been reflected in some domestic and foreign media, I found it necessary to provide explanations for this weird allegation against me.

After five years of unfair imprisonment due to political charges in Iran and when I was released from prison in 2014, and after being fired from my job as a teacher in Iran’s Ministry of Education, I cooperated for almost two years with a company owned by friends, which had been in International trade since 2000. Among the activities of this company is the supply and import of goods in limited areas, including medical equipment and some spare parts related to the railroad industry.

During my cooperation with the company, several orders for the supply of goods was referred to Mr. Arash Yousefi Jam, who was independently doing business in Canada, and he bought some of these goods and then sold them to the company I cooperated with. It is mentioned that I know Mr. Yousefi Jam since his several months of imprisonment in the Political ward of Evin prison and then he immigrated to Canada after his release. It is also mentioned that the purchase of all those goods and spare parts, which are mostly being purchased on famous online shops like Amazon and eBay, were not subject to any special terms or conditions (including IEEPA or ITSR). It should be noted that none of those goods are among Dual-use products. In summary, the introduction of Mr. Yousefi Jam as an Iranian citizen living in Canada who has been engaged in business, to an Iranian company is all I have done in the company.

I, Abdollah Momeni, consider myself a pro-democracy activist committed to the national sovereignty and independence of my own country, and I have always opposed the imposing of unilateral economic sanctions by the US government or any other government on Iran, which inevitably makes life difficult for the people of my country. I consider the sanctions an example of oppression against the Iranian nation and violation of the rights of Iranian citizens. Moreover, I have been repeatedly stated these beliefs in my personal or collective stances.

However, it is unfortunate how a government based in a developed country considers its domestic laws to apply to the citizens of another country to threaten and punish them, while at the same time forbidding the people of that country from traveling to its territory. The US Department of Justice must answer the question that under which principle of the international law do I, as a citizen of another country thousands of miles away from the United States, have to be aware of U.S. domestic law, and those rules apply to me and lead to punishment? How does this humorous process fit in with the right to a fair trial? Do we face the jungle law today?

Everyone knows that these irrational and illegal practices which are all against the international law, are the result of the decisions of an administration in the United States that has spent four years either banning, creating walls, and attacking democratic values, or in foreign policy just was looking for taking photos with dictators like the North Korean leader and extremists in Afghanistan, an administration whose approach, of course, was rejected by the majority of the American people.

I also need to declare with a louder voice than ever before that one of our country’s priorities today is transparency and the fight against corruption at every level. Also, I should mention that the resentments and attacks against activists believing in endogenous changes will not affect my determination.

However, it is not unexpected that a person like me who has always opposed foreign interference and internal authoritarianism to the best of his ability, being oppressed by both.
